Ask the Lawyer: Defense Available for Troops Unknowingly Absent from Military

Q. What happens if you?ve been AWOL for a long time without knowing it?

A. It?s not common, but it does happen: Service members unknowingly fall into absence without leave or deserter status.

Such situations sometimes arise after a service member gets in trouble off base and leaves civilian confinement.

In such instances, troops may be able to raise a mistake-of-fact affirmative defense. To understand how this defense plays into AWOL and desertion, it?s important to understand the nature of these crimes.

AWOL is a general intent crime, where a service member is not where he is supposed to be at a given time. Desertion is a specific intent crime, where the service member is not where he is supposed to be at a given time but has a specific intent to stay away from the military.

As the Navy-Marine Corps Court of Criminal Appeals noted in U.S. v. Campbell (1986), the mistake-of-fact defense can be raised by service members when an honest, mistaken belief led to a specific intent crime, such as desertion.

A service member must have had both an honest and reasonable mistaken belief to raise this defense in a general intent crime, such as AWOL. This is because, the court continued, the ?ignorance or mistake must have existed in the mind of the accused and must have been reasonable under all the circumstances.?

The Campbell case involved a Navy Reserve sailor who was convicted by special court-martial of desertion for 9? months and of AWOL for five days.

The sailor had left his ship without authorization shortly after Christmas and was apprehended by civilian law enforcement officers about 10 months later.

Thirty days into his unauthorized absence, his shipmates told the sailor that he had been discharged in absentia from the Navy ? which was a mistaken belief shared by his command.

Considering what the sailor?s shipmates told him and the fact that he continued living and working in the local community openly ? as opposed to going into hiding ? the court concluded the sailor had a valid mistake-of-fact defense that the government failed to rebut.

However, the court upheld the AWOL conviction because the sailor did not have a mistaken belief when he initially left his ship without authorization.

Regardless of the length of absence from the military, service members who are AWOL or listed as deserters should consult with a military law attorney who can help them explore possible affirmative defenses, such as mistake-of-fact or duress.

Giants headed home to face Cardinals; Bumgarner, Vogelsong to ...

Well now, that was a wild turn of events. As you likely know by now, the Giants will host the St. Louis Cardinals on Sunday in Game 1. Madison Bumgarner is starting that game and Ryan Vogelsong is starting Game 2. Nothing else was announced tonight, but Matt Cain will be on normal rest if he starts Game 3. Where does that leave Tim Lincecum and Barry Zito? We should find out tomorrow.

Here?s the quickie (unedited) preview story that I frantically filed for tomorrow?s paper, complete with some historical context from Dan Brown. If there are mistakes, it?s because we were also frantically trying to find a way back home. And that photo? Courtesy of Pablo Sandoval?s twitter account. The Giants headed to the airport midway through Game 5 in Washington and they thought they were about to fly to Washington. Two hours later they found out they?re headed home. I am too. Finally. So long, Cincinnati.

The last two World Series champions will face off in search of another title.

The St. Louis Cardinals overcame a 6-0 deficit in Washington on Friday night to stun the Nationals 9-7 and earn a trip to San Francisco for the National League Championship Series. The Giants watched the game on a tarmac in Cincinnati and now are guaranteed home-field advantage through the rest of the postseason.

?Wow ? going home with home field advantage,? right-hander George Kontos tweeted shortly before the plane took off. ?I like it.?

The Giants and Cardinals split a two-game series at AT&T Park in May and split four games at Busch Stadium in August.

The Cardinals will take the field at AT&T Park in Sunday?s Game 1 with several local ties. Manager Mike Matheny played for the Giants in 2005 and 2006 and was part of the Cardinals team that lost to the Giants in the 2002 NLCS.

The Giants swung a blockbuster deal for Carlos Beltran last season in an effort to get back to the postseason, but it never happened. Beltran signed with the Cardinals in the offseason and had three hits Friday night, including a double that started a four-run rally in the top of the ninth inning.

With the Cardinals one out from elimination, Bay Area native Daniel Descalso hit a two-run game-tying single. Pete Kozma followed with a single that put the Cardinals ahead for good.

?We know how to bounce back,? Descalso, a St. Francis (Mountain View) and UC Davis alum, told TBS. ?We?ve got grinders on this team.?

The Giants pride themselves on grinding, as well, and showed that trait this week while becoming the first team in MLB history to win three straight road games and overcome a two-game deficit in a best-of-five series.

The Cardinals have traveled an even wilder path.

They beat the Atlanta Braves in the first ever National League Wild Card Game and took a 2-1 lead in the NLDS before dropping Game 4 on a walk-off homer and falling far behind in Game 5.

Friday?s six-run comeback by the Cardinals was the biggest in a winner-take-all game in MLB history. They became the second team ever to overcome a multi-run deficit in the ninth inning of a winner-take-all game.

Before dropping the season-ending series in Los Angeles, the Giants had won 10 of 11 second-half series. The lone exception was a four-game set in St. Louis in August.

After the teams split the first two games, the Giants took the third game 15-0 behind Ryan Vogelsong, who on Friday night was announced as the Giants? Game 2 starter in the NLCS. Madison Bumgarner will start Game 1, and he pitched well in his last matchup with the Cardinals.

Bumgarner struck out seven but gave up three runs in six innings and the Giants never could climb back after Beltran hit a two-run homer in the first inning.

Bumgarner, Beltran and two evenly matched teams will play two games in San Francisco before heading to St. Louis for up to three games. If the series advances beyond that, the Giants will get the final two games at home.

These two franchises have been here before, too.

In fact, the ?One Flap Down? can still stir the passions of anyone who witnessed the 1987 NLCS.

In that memorable seven-game showdown, Giants outfielder Jeffrey Leonard hit .417 with four home runs, and he did it with controversial style. Leonard would round the bases slowly, with one arm dangling at his side.

Giants fans loved the act, but not the Cardinals. Bob Forsch drilled Leonard with a fastball in Game 3, adding spice to an already dramatic series. The Cardinals triumphed in Game 7, fueled by Jose Oquendo?s three-run home run off Atlee Hammaker.

(Leonard was the MVP of that NLCS, even in a losing cause).

The Giants got the best of the rematch when they met the Cardinals in the NLCS again in 2002. The series required only five games and Kenny Lofton delivered a memorable winner by driving home David Bell with two out in the bottom of the ninth of Game 5.

It was the Giants? first pennant-winning walk-off hit since Bobby Thomson?s Shot Heard ?Round the World in 1951.

Rumored iPad mini event to be focused on iBooks and education as well as new hardwareWe heard yesterday from some very reliable sources that Apple would be holding an event to launch the iPad mini later this month; October 23 to be more precise. Some more information is starting to slip out and it appears that the actual event may be focused on Apple?s iBooks store and of course education. The news comes from The Next Web who has now heard this from multiple sources.

In what will likely be completely unsurprising news to many, we?ve now heard from multiple sources that Apple?s as-yet-unannounced iPad mini event will have a strong focus on iBooks. Since an iPad mini would likely be squarely aimed at those who wish to partake of media on their tablets that would make a lot of sense.

The event will, of course, be primarily devoted a new hardware device, which iMore first reported would be a thinner, cheaper version of Apple?s iPad. But the primary purpose of such a smaller tablet would be to act as a conduit for Apple?s content, namely iBooks publications and movies.

When you think about it, the focus on iBooks does make a lot of sense. The iPad mini would be a killer device in the education market. The fact that it would be a much more affordable device as well would make it perfect for students to carry around with all of their text books stored on it. The iPad mini event is supposedly just around the corner so we will not have much longer to wait to see what Apple has up its sleeve. We would expect the invites for the event to start arriving for the chosen few in the very early part of next week. Who's excited?

(AP) ? A body found in a suburban Denver park was identified Friday as that of a missing 10-year-old girl, as anxious parents kept close watch over their children because of the potential presence of a predator in their midst, authorities said.

The body of Jessica Ridgeway was found Wednesday about 7 miles southwest of her home. Authorities said it was not intact, and DNA was used to identify her.

"Our focus has changed from the search for Jessica to a mission of justice for Jessica," Westminster Police Chief Lee Birk said.

"All our efforts now are in search of her abductor," he said. "We recognize there is a predator at large in our community."

Jessica began a short walk from her home to Witt Elementary School on the morning of Oct. 5 but never arrived. A massive search did not start until hours later because Jessica's mother works nights and slept through a call from school officials saying Jessica wasn't there.

The FBI has warned residents that she may have been abducted by someone they know and is asking them to be alert for people they know who might have suddenly changed their appearance or uncharacteristically missed work or appointments.

"It could be your boss, it could be your friend, and ultimately it could be your family member," FBI spokesman Dave Joly said previously. "We suspect someone in the community knows this individual."

Jim Yacone, FBI special agent in charge of the Denver division, said investigators would continue neighborhood searches. The U.S. Marshals Service, immigration officials and state Department of Corrections have been reviewing registered sex offenders in the area, he said, without elaborating.

Investigators have received more than 1,500 tips from the public, roughly 800 of which have been covered, Yacone said. Authorities also have searched more than 500 homes and more than 1,000 vehicles but still need the public's help.

"We want you to look for changes of habits, patterns, peculiar absences of those around you and report it to law enforcement," he said.

Signs of the tragedy have been everywhere in Jessica's neighborhood of modest, two-story homes with single-car garages.

During the past week, officers have searched homes and yards. They kept guard at crosswalks and photographed cars entering the neighborhood. Mailboxes and trees were encircled by ribbons in Jessica's favorite color, purple.

"I don't feel safe for my daughter anymore, anywhere," said Stacey Oppie, who lives in the neighborhood.

Two months ago, Oppie started letting her daughter play unsupervised with a friend at the park that Jessica customarily passed on her way to school. She doesn't intend to do that anymore.

"We're all a little bit on alert, but it's not fear. We're angry because this is a good neighborhood," Oppie said.

Jessica's disappearance hit close to home for Chelsea Bozsak, a senior at nearby Standley Lake High School, where Jessica's cousin attends classes. Students there wore purple Friday in support of Jessica's family.

"It's so scary because you never think something like this could happen in your community," Bozsak said.

Courtney Sullivan, also a senior at Standley Lake, said her father spoke to her and her younger brother about Jessica's disappearance.

"He's definitely talked to us about being more careful about our surroundings. You could see why," said Sullivan, a cross-country runner who often uses neighborhood streets. "I'm running in places where there's lights, busy roads, where I can get to someplace if I need to."

Community members planned a gathering Saturday to celebrate Jessica's life.

Retired FBI behavioral analyst Clinton Van Zandt said tip-offs about the suspect could include someone suddenly growing a beard, getting a new haircut or other changes in appearance. Other clues might be out-of-character behavior, he said.

Police have said they don't suspect Jessica's parents, Sarah Ridgeway, who lives with Jessica in Westminster, and Jeremiah Bryant, of Missouri.

The only substantive clue police have disclosed was the discovery two days after she disappeared of her backpack and water bottle in Superior, about six miles northwest of her home and several miles south of where her body was found. Police won't discuss what was found in the bag or test results involving it.

Law-enforcement leaders said they would not disclose further information publicly so as not to jeopardize the investigation.

They have not ruled out that the search for the suspect could be national, an FBI spokesman said.

"The commitment of the task force of investigators in this case will not waver, and our commitment and resolve to seek justice on behalf of Jessica will only grow stronger," Yacone said.

As Election Day nears, Romney crowds are surging

(AP) ? The crowds tell the story. As Election Day nears, Mitt Romney is drawing large and excited throngs.

Look to dusty Iowa cornfields, rain-soaked Virginia parks, the muddy fields of the Shelby County Fairgrounds, where a crowd of 9,500 ? almost half of this western Ohio town ? gathered among the barns and stables on a frigid October evening this week to glimpse the Republican presidential contender.

"Where else would we want to be?" said one of the shivering faithful, Judy Cartwright, a 71-year-old nurse from Sidney. "I want to see the next president of the United States."

Romney's debate performance against President Barack Obama last week ? and his energetic appearances following it up ? have fueled a rise in enthusiasm on the campaign trail. Whether or not it will translate into votes, polls do suggest that Republicans are fired up. It's a welcome development for the Republican businessman, who is hardly a natural politician and has long struggled to match Obama's ability to inspire excitement.

Romney seems to be feeding off the energy pumping through his now-sprawling crowds, even as aides downplay the newfound momentum among the GOP base.

"I'm overwhelmed by the number of people here," he exulted while scanning the sea of supporters packed beyond the fairgrounds fences here. "There are even people out there ? that's another county over there."

Romney's growing crowds come as new polls suggest he has erased Obama's advantage in voter support nationally. Races have tightened in a handful of battleground states, too.

The president's challenge on the campaign trail this year has been to match the high excitement bar he set in 2008. For Romney, it has been to exceed low expectations.

But recent polling suggests the "enthusiasm gap," long thought to lean toward Obama, has leveled off.

The Pew Research Center poll this week found that 68 percent of registered voters who back Obama support him strongly. Some 67 percent of Romney voters are strongly behind him. That's the first time Pew's poll has found the two candidates even on this measure.

And a Washington Post-ABC News poll conducted after the Oct. 3 debate showed the GOP nominee drawing "strongly favorable" reviews from 62 percent of Republicans, the highest level of deeply positive views that poll has found during the campaign. Overall, Romney's favorability among Republicans stands at 87 percent. Obama draws favorable views from 93 percent of Democrats, including 68 percent who hold strongly favorable views.

Obama can still turn out big crowds. As the election draws close, the president is appearing in college settings where he can depend on the enthusiasm of younger supporters. Within the past nine days, he has spoken before 30,000 people at the University of Wisconsin, 15,000 at Ohio State University and 9,200 at the University of Miami.

But in 2008, to note one striking example, he drew an astonishing 100,000 people to a single rally in Denver in late October. And this year's campaign audiences, like Obama himself, seem to vary in their enthusiasm. The students who filled a field at Ohio State on Tuesday were supportive but hardly buzzing when Obama implored them to vote.

One recent night, at a concert hall in San Francisco, Obama showed he can still whip 6,000 supporters into building cheers.

"I still believe in you. I'm asking you to keep believing in me," he declared. "I'm asking for your vote. I'm asking you to knock on doors. I'm asking you to make phone calls. And if you do, we will win this election. We'll finish what we started. And we'll remind the world why the United States of America is the greatest nation on earth."

The level of enthusiasm matters as each side tries to get as many of its supporters to the polls as possible. A big Republican enthusiasm advantage two years ago helped the GOP capture control of the U.S. House of Representatives in addition to making huge gains in statehouses across the nation.

For much of this year, Romney, the sometimes-stiff former businessman, has had a hard time generating the same electricity as Obama.

Indeed, most of the GOP's most passionate voters did not back Romney during the extended Republican primary season. His campaign typically favors made-for-TV invitation-only events where the emphasis is imagery ? Navy ships, manufacturing plants, farm equipment ? rather than crowd size. Audiences did increase as Romney began campaigning alongside running mate Paul Ryan, a favorite of the tea party, but he has generally struggled to get people excited on his own.

He drew an estimated 12,000 people to a central Florida rally last weekend, 1,200 to an Iowa town of just 1,000, and several hundred more to Newport News, Va., under heavy October rain.

"People wonder why it is I'm so confident we're going to win. I'm confident because I see you here on a day like this. This is unbelievable," Romney said, his wet hair stuck to the side of his face.

Soaked supporters standing in muddy puddles cheered as he delivered an abridged version of his standard campaign speech. Some wore ponchos, while many others stood shivering and drenched, hands in pockets.

At the Shelby County Fairgrounds, Judy Cartwright was wearing four layers to try to keep warm as the cold wind pushed temperatures into the 30s Wednesday night. It was Shelby's first glimpse of a presidential candidate since she met Harry Truman as an elementary school student more than six decades ago.

"At least it's not snowing," she said with a smile. "This is a chance of a lifetime."

The trials of cycling in bike-hostile Moscow

MOSCOW (AP) ? One popular joke in Moscow goes: "When the drunken driver was taken to the police station he was already sober. Why? Traffic jams."

With congestion in the capital going from bad to infernal, an increasing number of people see cycling as a solution.

But riding a bike in Moscow is somehow a different experience from cycling in any other European city. With no bike lanes but plenty of road rage, most cyclists in Moscow, myself included, keep off the streets and stay on the sidewalk. But while cycling on the pavement, you need to watch out not only for pedestrians and baby carriages but for the sudden opening of car doors. Yes, parking on the sidewalk is also OK in the Russian capital.

Traffic jams have become as recognizable a feature of Moscow as the Kremlin's onion domes. Congestion is so bad that it's common to travel three hours from downtown to the outskirts in rush hour. Motorists are estimated to spend an average of 15 hours a week stalled in traffic.

So in a truly revolutionary step to make Moscow bike-friendly and ease congestion, the city government has earmarked more than 600 million rubles ($20 million) over the next four years to build cycling paths and bike racks.

I started cycling to work in the summer of 2010 when a colleague, who lives much farther from the office than I do, mentioned that he occasionally cycles to work. Just five years ago the only people who rode bikes in Moscow were either teenagers or eccentric elderly men. Now it's not unusual to see an investment banker cycle to work.

I try to cycle to work a couple of times a week in warm weather, which is May through early October here. Despite the lack of bike lanes and the hostility of motorists and pedestrians alike, cycling in Moscow can be a joy compared to the headaches of driving: You fly past the gridlock and don't have to worry about finding a parking spot.

For Vladimir Kumov, founder of Let's bike it!, a group that promotes cycling in Moscow, the awakening came two years ago when he spent three hours in traffic driving in from the airport after a three-month trip to Argentina, where he cycled all over town between his job and Spanish classes.

"People are tired of wasting their time in traffic, tired of seeing this city clogged with cars, and are starting to realize that we can change the way we live now," he said.

My cycling day starts with carrying my bike down three flights to the street. One of the issues that Moscow cyclists face is a near complete absence of bike racks. Because there are none in my neighborhood ? and I had a bike stolen once even from inside my apartment building ? I keep my bicycle on my balcony. Carrying the bike up and down the steps is probably the most physically challenging part of my journey. Like most Soviet-era apartment buildings, mine is not equipped to meet the needs of cyclists, wheelchair users or parents with prams.

There's only one cycling path in this city of 12 million and no bike lanes on the roads whatsoever. Traffic rules in Russia provide for cycling on the road, although cyclists are not welcome there. Nor are they appreciated by pedestrians. For me the choice comes down to this: Either risk breaking your neck on the road, where motorists are aggressive and routinely run red lights, or cycle on the sidewalk, even if that means getting nasty looks and having to dismount often to maneuver through crowds.

An overwhelming majority of cyclists in Moscow prefer not to test their luck on the dangerous roads.

My 10-kilometer (6-mile) route takes me through some of the city's greenest and most picturesque areas: leafy Sparrow Hills and the park near Moscow State University. But some parts of my route are unpleasant in a bizarre way. I still can't grasp why a pole with a road sign had to be placed right in the middle of a sidewalk, on a cement slab so large that I have to squeeze through every time I ride by.

And there are other small inconveniences, like steep and uneven curbs, which also have me hopping on and off my bike -- and are a major headache for the handicapped. The city has made some progress in recent years making the sidewalks more wheelchair-friendly. Even so, it is not uncommon for an embankment to end suddenly with a flight of stairs.

The AP Moscow bureau is inside a sprawling compound that houses the offices of scores of foreign media organizations as well as apartments for journalists and diplomats. Still, there's only one bike rack for the entire compound, so I normally leave my bike chained to a railing, which is more or less safe because of video surveillance.

The Kremlin, apparently, is no better equipped.

When Masha Gessen, a prominent journalist, had a meeting with President Vladimir Putin in September, his staff told her there was nowhere to park her bike inside the Kremlin, so she had to leave it chained up at a bus stop nearby.

Desperate to do something to ease Moscow's traffic congestion, city authorities hope that cycling can be part of the solution. Muscovites own about 3 million bikes, but few use them as a means of transportation, according to a recent report.

In the next four years, the city plans to increase the number of bike paths to 72 and the number of bike racks to 17,000.

The city expects the bike paths to help increase the average speed of cycling to 15.5 kilometers (9 miles) per hour and the share of those cycling to work from 0.01 percent to 1.2 percent by next year. For the city of 12 million, that would be 144,000 people.

While supportive of the city plans, cycling activist Kumov remains skeptical, largely because many of the paths are going to be built in parks, thus chiefly to promote cycling as recreation and not as a means of transport.

"The way the plan looks now will probably make little difference," he said.

LAKE FOREST, Ill. (AP) - It's not cheap feeding hungry Bears.

Chicago's Shea McClellin learned that when he was handed a dinner tab for more than $38,000. Good thing for him, it was only a joke.

The Bears decided to play a prank Tuesday night at Mastro's Steakhouse in Chicago when they handed their first-round draft pick and practice squad defensive end Aston Whiteside a bill for $38,091.91 after a rookie night dinner.

Veteran defensive end Israel Idonije says "they didn't know what to do with themselves" and watched for about five minutes as they discussed how they were going to pay for it before they were told the tab was phony. McClellin told reporters the actual bill was for more than $10,000.

Idonije posted a picture of the fake receipt on his Twitter account.
